Welcome to FakeNewsPrank. By accessing or using our website and services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the service.

1. Description of Service

FakeNewsPrank provides a parody and satire article generator. Users can upload photos, select story templates, and generate fictional "news" articles with AI-generated text and images. All content produced is intended solely for entertainment and is clearly labeled as parody and satire. The service is not a news source and must not be used to deceive others into believing that generated content is real news.

2. Eligibility

You must be at least 13 years of age (or the age of majority in your jurisdiction, if higher) to use the service. By using the service, you represent that you meet these requirements and have the authority to enter into these Terms.

3. Accounts and Credits

Certain features may require an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Credits purchased for article generation and image rerolls are non-refundable except as required by law or as stated in our refund policy. Credits do not expire. We reserve the right to modify credit pricing and pack offerings with reasonable notice where feasible.

4. User Content and License

Your content. You may upload photos and provide other content ("User Content") to generate parody articles. You retain ownership of your User Content. You grant us a worldwide, non-exclusive, royalty-free license to use, store, process, display, and host your User Content and the resulting generated articles (including AI-generated text and images) solely to provide and operate the service, including hosting shareable article links and improving our systems.

Your responsibility. You represent and warrant that you have all rights necessary to submit your User Content and grant the license above (e.g., you have consent from individuals in photos where required). You are solely responsible for your User Content and how you use and share generated articles. We do not endorse and are not responsible for any User Content or generated content.

5. Acceptable Use and Prohibited Conduct

You agree to use the service only for lawful, non-harmful parody and satire. You must not:

• Use the service to create content that is defamatory, or that harasses, threatens, or intimidates any person
• Impersonate another person or entity for fraudulent or harmful purposes
• Create content that could reasonably be mistaken for real news with the intent to deceive or cause harm
• Upload or generate sexually explicit, obscene, or illegal content
• Use the service to violate any applicable law or third-party rights
• Attempt to gain unauthorized access to our systems, other accounts, or data
• Scrape, automate, or overload our systems in a way that impairs the service

We reserve the right to remove content, suspend or terminate accounts, and refuse service to anyone who violates these Terms or who we reasonably believe is misusing the service.

6. Generated Content and Disclaimers

All articles and images generated by the service are fictional and for entertainment only. They are clearly labeled as parody and satire. We do not guarantee accuracy, quality, or appropriateness of generated content. Use of the service and reliance on any generated content is at your own risk. We are not liable for how you or others use or interpret generated content.

7. Intellectual Property

Except for User Content and generated content (as between you and us), FakeNewsPrank and its licensors own all rights in the service, including the website, design, branding, and technology. You may not copy, modify, distribute, or create derivative works of our service or branding without our prior written permission.

8. Takedowns and Reporting

We provide tools to report content and to submit takedown requests (e.g., if you are the subject of an article and want it removed). We will process valid requests in accordance with our policies and applicable law. Repeated misuse of reporting or takedown processes may result in action against your account.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAKENEWSPRANK AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN SUCH CASES, OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

11. Indemnification

You agree to indemnify, defend, and hold harmless FakeNewsPrank and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the service; (b) your User Content or generated content; (c) your violation of these Terms or any law; or (d) your violation of any third-party rights.

12. Termination

We may suspend or terminate your access to the service at any time, with or without cause or notice. Upon termination, your right to use the service ceases. Provisions that by their nature should survive (including disclaimers, limitation of liability, indemnification, and governing law) will survive termination.

13. Changes to the Service and Terms

We may modify the service or these Terms at any time. We will post updated Terms on this page and update the "Last updated" date. Material changes may be communicated via the service or email. Continued use of the service after changes constitutes acceptance of the new Terms. If you do not agree, you must stop using the service.

14. General

Governing law. These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of law principles.

Disputes. Any dispute arising from these Terms or the service shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.

Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect.

Entire agreement. These Terms, together with our Privacy Policy and any other policies we reference, constitute the entire agreement between you and FakeNewsPrank regarding the service.
